Are electronic signatures legal in El Salvador?

Legislative Decree 133 of 1 October 2015, the Electronic Signature Act, published in Diario Oficial No. 196, Volume 409, of 26 October 2015, sets the current rules. It entered into force on 23 April 2016. Article 1, as later reformed, says the Act equates a simple electronic signature and a certified electronic signature with a handwritten signature, grants legal effect to certified signatures, electronic seals, time-stamps, electronic documents, and data messages, and regulates accredited certification and storage providers. Article 3(l) defines a simple electronic signature as electronic data in a data message or electronic document, logically associated to it, that can identify the signer by any available technological means and show that the signer approves the information. Article 6 says a simple electronic signature has the same legal validity as a handwritten signature. As to its legal effects, it does not have the same evidentiary value that the Act gives a certified electronic signature, but it may be an element of proof under the rules of sana crítica. Article 7 says acts and contracts signed with an electronic signature are valid in the same way and produce the same effects as those made in writing on paper, except acts that need special formalities or solemnities that cannot be met electronically. The standard inSigner signature is a simple electronic signature under article 3(l). It is not a certified electronic signature under article 3(m). Whether a given document is valid still depends on the document and the law that governs it. inSigner does not decide that question.

What do articles 3 and 24 require for a certified electronic signature?

Article 3(m) defines a certified electronic signature as electronic data generated with a secure creation device that exclusively links the signature to its holder. Article 3(d) and article 3(q) say an electronic certificate is issued by a certification-service provider accredited by the Unidad de Firma Electrónica. Article 24 says a certified electronic signature has the same validity and the same legal and evidentiary effects as a handwritten signature on the electronic document or data message where it is used. Article 25 adds presumptions of attribution and integrity unless proven otherwise. Article 8 gives full evidentiary effect to public and private documents signed with a certified electronic signature. Articles 35 and 36 create the Unidad de Firma Electrónica as part of the Ministry of Economy, the root accreditation authority for certification and storage providers. inSigner is not that unit and is not an accredited certification-service provider. QES for Europe is an Enterprise option and is not a Salvadoran certified electronic signature.

How does the record show who signed what?

Each person signs the fields you placed on the document you sent. The evidence record keeps their name and email or phone, when the document was sent, viewed, and signed, the IP address, the device data, and the authentication used.

Can I download the evidence for a completed document?

Yes. You can download the completed PDF and the evidence record, including a SHA-256 hash of the final file. If a single byte changes, the hash no longer matches. The hash shows whether the final file still matches. It is not a certified electronic signature under article 3(m), and it is not encryption. Article 6 says a simple electronic signature may be an element of proof under the rules of sana crítica. The hash does not by itself decide that article or article 24.

Is the standard signature a certified electronic signature or a QES?

No. Essential and Pro use a simple electronic signature. Article 3(m) and article 24 of Legislative Decree 133 treat a certified electronic signature as one generated with a secure creation device and an electronic certificate from a provider accredited by the Unidad de Firma Electrónica. inSigner is not that provider. QES for Europe is an Enterprise option, priced separately, and it is not a Salvadoran certified electronic signature. It is not on Essential or Pro.

Does article 6 cover a public instrument, a notarial act, or a State act that needs a certified signature?

No. Article 7 leaves out acts that need special formalities or solemnities that cannot be met electronically. Article 8 gives full evidentiary effect to public and private documents only when they are signed with a certified electronic signature. Article 30 says State officials need a certified electronic signature for acts that grant rights, impose sanctions, or constitute confidential information under article 24 of the Access to Public Information Act, except constitutional or legal solemnities that cannot be electronic. inSigner does not act as a notary, does not witness a signature, and does not file a document in a public registry. Your counsel decides the form a document needs.

Does accepting the process satisfy article 6 or article 24?

Not by itself. Accepting the electronic process in inSigner records consent to sign that document. It does not, by itself, decide the evidentiary value of a simple electronic signature under article 6, and it does not create a certified electronic signature under article 3(m) or article 24. inSigner does not decide those points for you.

Does inSigner make a workflow comply with local privacy law, or cover clinical consent and uptime?

No. For the documents you send, you decide the purpose. inSigner does not write your privacy notice and does not make a workflow compliant with Salvadoran privacy or data protection law, including article 5 of Legislative Decree 133 for certification and storage providers. Nubesti handles the account, billing, security, support, and marketing. Do not use the product by default for patient forms, clinical consent, account opening, credit decisions, or KYC. Identity checks are add-ons priced separately. There is no public status page and no uptime percentage. The mobile apps are planned, not a public download.
