Electronic signatures in Germany
German law follows eIDAS and adds the Civil Code and the Vertrauensdienstegesetz. The written form in §126 BGB is not the same thing as the electronic form in §126a.
The framework
Many commercial contracts have no statutory form and can use a simple electronic signature. When the law requires the electronic form, §126a BGB points to a qualified electronic signature.
QES for Europe is an Enterprise option. The standard signature on Essential and Pro is not that qualified signature.
The record
A standard inSigner signature is an electronic signature with a completion record. It is not a qualified electronic signature. QES and the AATL check are Enterprise options.
The record connects the document hash, the people invited, and the completion events. It does not replace a notarization, a wet-ink statute, or advice from your counsel.
